Elon Musk’s X has won a tentative dismissal of a gender discrimination lawsuit filed by two former Twitter Inc. employees. The plaintiffs allege that the company targeted female employees when it began mass layoffs at the company after Musk bought the company in 2022.
In his ruling on Monday, U.S. District Judge John Tigar noted that it’s not clear whether the plaintiffs were fired during Musk’s mass layoffs at Twitter or if they left the company for other reasons. The judge also noted that even if they were included in Musk’s mass layoffs, they haven’t actually alleged that their gender motivated the company’s decision, as Reuters reported.
“Plaintiffs allege they worked for Company X until November 2022 and detail terminations that occurred during that month, but never allege they were the subject of those terminations. Second, even if we assume that Plaintiffs were terminated, the case still does not include sufficient factual allegations from which it can be reasonably inferred that they were terminated because of their sex.”
“The amended complaint contains nothing to suggest that similarly situated men were treated more favorably when compared with the qualifications, experience or job performance of the male employees who were not fired,” Judge Tigar wrote, again dismissing the case.
The plaintiffs in the suit, Carolina Bernal Streifling and Willow Len Turkal, worked at Twitter until November 2022. In their complaint, they alleged that Twitter favored male employees by firing 58% of its female engineers and only 45% of its male engineers. The plaintiffs also argued that some of Musk’s comments were sexist. However, Judge Tiger dismissed these claims.
“For the reasons explained in the Court’s prior orders, X’s CEO Elon Musk’s allegations of statements and statistics do not justify a claim that X engaged in a pattern or practice of discrimination. Plaintiffs’ new allegation that Musk used white paint to cover up the ‘w’ in the ‘Twitter’ sign in April 2023 is similarly insufficient because this conduct is unrelated to the RIF,” Judge Tigar wrote.
